世界银行营商环境评估体系在全球具有广泛的影响力和公信力，对各国和经济体改善营商环境发挥了重要指引作用。2023年，世界银行开始推行营商环境评估的新体系—Business Ready（B-READY），针对环境许可设置了独立问卷。本文对该问卷进行系列解读。

能否对环评审批决定提出异议？

是。根据《中华人民共和国行政复议法》《中华人民共和国行政诉讼法》，当事人对环境许可结果提出异议的，可以向行政复议机关提出行政复议申请，也可以向人民法院提起行政诉讼。

Can I raise objections to EIA approval decision?

Yes. According to theAdministrative Reconsideration Law of the People’s Republic of China and the Administrative Procedure Law of the People’s Republic of China, a party that objects to the result of an environmental clearance can either apply for administrative reconsideration to an administrative reconsideration organ or initiate legal proceedings with a people’s court.

对环评审批结果不服能否申请行政裁决或者调解？

是。我国建立有行政复议制度，与英国行政裁判所、美国行政法法官等制度的功能类似，是行政诉讼之外的一种重要行政纠纷解决机制。公民、法人或者其他组织认为行政机关的具体行政行为侵犯其合法权益时，‌可以依照《‌中华人民共和国行政复议法》‌的规定向行政复议机关提出复议申请，‌这些行为包括但不限于‌行政许可决定、行政处罚决定等。

我国各级人民法院积极推进行政争议多元化解工作，引导、鼓励和支持当事人选择行政和解、行政裁决、行政调解或者申请仲裁等非诉讼方式解决争议。

Can I apply for administrative adjudication or mediation if I am dissatisfied with the EIA result?

Yes. China has implemented an administrative reconsideration system, comparable to the UK’s Administrative Tribunal system and the US’s Administrative Law Judge system. It plays a vital role in resolving administrative disputes, complementing the process of administrative litigation. If citizens, legal persons, or other organizations consider that their lawful rights and interests have been violated by an administrative act, they can apply for administrative reconsideration to an administrative reconsideration organ in accordance with theAdministrative Reconsideration Law of the People’s Republic of China. Acts that can be disputed include but are not limited to, administrative licensing decisions and administrative penalties.‌

People’s courts at all levels in China are actively advancing the diversified resolution of administrative disputes by guiding, encouraging, and supporting parties to choose non-litigious methods such as administrative reconciliation, administrative adjudication, administrative conciliation, or arbitration.

可以在网上提起环境许可决定争议吗？

行政复议和行政诉讼都可以通过网上办理。当事人可以通过行政复议网上申请平台申请行政复议，在上海法院诉讼服务网提起行政诉讼，也可在上海市“一网通办”平台办理。

Shanghai has introduced an integrated government service platform, the “Government Online-Offline Shanghai”. The platform also offers features such as online inquiries, notifications, and automatic checklist generation, all free of charge.

环评相关管理的要求是否可以通过网络在线获取？

《〈建设项目环境影响评价分类管理名录〉上海市实施细化规定（2021年版）》根据项目的行业性质、规模及位置敏感性，明确各类建设项目是否需要开展环评以及环评文件形式，包含了高、中、低各种环境影响程度的建设项目。本市开通“一网通办”政务服务系统，企业可在线查询环评审批申请材料、流程等要求。上海市生态环境局官网开设“营商环境专栏”，公众可查询项目是否需要开展环评及环评形式。

Are the requirements for environmental impact assessment management available online?

According to the Detailed Implementation Rules of Shanghai Municipality for Classified Management Directory for Environmental Impact Assessment of Construction Projects (2021 Edition), the need for an EIA and the form of the EIA document required depend on the nature of the industry, the size of the project, and its location sensitivity. The Rules address projects with high, medium, or low environmental impact. Businesses can access the requirements for EIA approval application materials and process online via the city’s “Government Online-Offline Shanghai” platform. The public can find information on the need for an EIA and its form in the “Business Environment” section of the Shanghai Municipal Bureau of Ecology and Environment’s official website.

在哪里可以获取环评审批统计数据？

各级生态环境部门官方网站对建设项目环评审批决定进行公开。上海市生态环境局每年发布生态环境公报，包括当年度环评审批数量，持续时间五年以上。生态环境局官网开设“营商环境专栏”，公众可了解近五年本市环评审批数量。

Where can I get the statistical data on EIA approval?

Ecological and environmental departments at all levels publicize the environmental impact assessment approval results of construction projects on their official websites.The Shanghai Municipal Bureau of Ecology and Environment publishes an ecological and environmental bulletin annually, which includes the number of EIA approvals for the current year and data from the past five years. Additionally, the Bureau’s official website has a “Business Environment” section where the public can access information on the number of EIA approvals in the city over the past five years.

本市对于环评报告书和报告表的承诺办理时间压减为15个工作日和7个工作日（不含技术评估时间和法定公示时间）。环评审批不需要缴纳费用。

What is the time limit and cost for EIA approval documents?How long does a real estate project usually take?

The promised processing time for the environmental impact assessment report and report form in the city has been reduced to 15 working days and 7 working days (excluding technical evaluation time and statutory public announcement time).

Real estate projects that do not involve environmentally sensitive areas are not required to have an EIA permit.Consequently, the time limit and the cost required to complete EIA approval documents is 0.
