中国消费者朱燕翎女士致雀巢公司的信

　　新浪财经讯 朱燕翎女士是中国状告雀巢第一人，她今年4月将瑞士雀巢公司及上海雀巢告上法庭，后撤回对总公司起诉。这是中国第一起消费者状告食品生产商因没有标注转基因食品，侵犯知情权的案件。以下为朱燕翎女士致雀巢公司的公开信（英文，后附中文译文），内容如下： ：

　　Dear Sir/Madam,

　　As you are aware, Nestle’s history in China has been a successful one. Nestle is the one of the earliest foreign food producers to enter the Chinese market. For many Chinese consumers, Nestle is synonymous with coffee. This is just one example of the huge popularity of the Nestle brand in China.

　　Being a Chinese consumer, I grew up with Nestle products. During my studies in Switzerland, I was fortunate enough to be given a visit of Nestle’s headquarters in Vevey by a friend of mine. The visit left a good impression on me, and it increased my trust in Nestle’s products. After I gave birth to my child three years ago, I chose to buy Nestle’s products for my baby without any hesitation. Because of my fondness for and trust in Nestle’s products, I am also very concerned with Nestle’s development in China.

　　However, one day, I was shocked to learn from the Internet that Nestle’s Nesquik contains genetically engineered (GE) ingredients! After I confirmed that Nestle’s Nesquik does contain GE ingredients that are not properly labeled, shock turned to anger. I have been unknowingly feeding my baby with GE food!

　　I am angry because Nestle has not been truthful. This is disrespectful to Chinese consumers. I decided to initiate a court case against Nestle. The damage compensation I am demanding is small, but I believe Chinese consumers have the right to know and choose what they are buying for their families.

　　As far as I know, Nestle has pledged publicly to stop using GE ingredients in many European countries, especially in baby food products. In subsequent communications between Nestle and my lawyer, Nestle failed to provide satisfactory explanations for its“double standard”: why is a globally famous baby food producer adopting different policies in different parts of the world? Why is Nestle ignoring consumers’right to know by not labeling its GE products?

　　As an ordinary consumer and mother of a son, I sincerely hope Nestle can give me an answer. I demand (1) Nestle to adopt the same policy in China as in European countries, that is, to eliminate GE ingredients from its products and (2) to pay full respect to consumers’right to informed choice by properly labeling its GE products.

　　I am making these demands because there are millions of mothers in the world who trust Nestle to provide their kids with nutritious food. Please do not abuse the trust of these mothers and their children!

　　我们大家都知道，雀巢在中国的发展历史是非常成功的。雀巢是最早进入中国市场的外国食品生产商之一。对于很多中国消费者来说，“雀巢”和“咖啡”几乎是同义词，而这仅仅是雀巢品牌在中国空前流行的实例之一。

　　身为一名中国消费者，我的成长过程中总有雀巢产品相伴。在瑞士留学期间，我曾经荣幸的应邀参观了位于瑞士维维城的雀巢总部。这次参观给我留下了很好的印象，也增加了我对雀巢产品的信赖。三年前我有了自己的小孩，我毫不犹豫的为他选择了雀巢食品。源于我对雀巢产品的热爱和信赖，我也一直很关注雀巢在中国的发展。

　　然而有一天，我非常震惊的在网上发现雀巢“巧伴伴”食品含有转基因成分！当我确认雀巢“巧伴伴”的确含有转基因成分并且没有在包装上明确标注时，震惊变为了愤怒。我在不知情的情况下竟然给我的孩子食用了转基因食品！

　　我愤怒是因为雀巢的不诚实。这是对中国消费者的不尊重。我决定对雀巢提起法律诉讼。我要求的损害赔偿额是很小的，但是我坚信中国消费者有权利知道他们为自己的家庭购买的是什么样的产品。

　　据我所知，雀巢在欧洲公开表示停止销售含有转基因成分的产品，尤其是在婴儿食品市场。在后来雀巢与我律师的沟通中，雀巢未能就它的“双重标准”给出一个合理的解释：为什么一家全球驰名的婴儿食品生产商在世界的不同地区采用不同的政策？为什么雀巢不明确标注它的转基因食品而不顾消费者的知情权？

　　作为一名普通消费者，作为一个孩子的母亲，我真诚希望雀巢能给我一个答案。我要求：第一，雀巢在中国应采用同在欧洲国家一样的标准，即去除产品中的转基因成分；第二，正确标示它的转基因产品，给予消费者充分的知情权和选择权。

　　我提出这些要求是因为全世界有数以百万计的母亲相信雀巢能够为她们的孩子提供营养食品。请不要罔顾这些母亲和孩子的信任！
