近日，本报记者向美国哈佛商学院(HBS)求证，哈佛商学院就此回复本报记者声明，哈佛商学院HBS和这家所谓“美国哈佛商学院”没有任何关系。哈佛商学院没有与任何其他的美国以外的学校合作颁发任何MBA学位，哈佛大学在中国也没有这方面的任何分支机构。
此外，哈佛大学表示他们正在关注此事，并会采取适当的行动来阻止任何未取得许可而使用哈佛名称的行为，以及所有这家“美国哈佛商学院”所造成的混淆。事实上，哈佛大学已经在中国教育服务领域注册了“哈佛”的中文名字以及拉丁字母写法。“美国哈佛商学院”除了使用“Harvord”还使用中文汉字“哈佛”作为他们的名称，这就是“美国哈佛商学院”侵犯商标和非法使用哈佛商学院名称的进一步证明。

关于你提出的具体问题，哈佛商学院HBS和这家美国哈佛商学院America Harvord Business Institute没有任何关系。而且，哈佛商学院在亚太地区的研究中心位于香港，日本研究办公室位于东京。关于这些研究中心的详细的资料可以在哈佛商学院的网站找到，地址是：http／／www.hbs.edu／global／research＿centers.html。然而，哈佛商学院没有与任何其他的美国以外的学校合作，和颁发任何的MBA学位，因此哈佛大学在中国没有这方面的任何分支机构。

Thank you for bringing this matter to Harvard University's and the Harvard Business School's attention. Your email to Eileen was forwarded to me at the Trademark Program for consideration and possible action. We will now be in touch with our Chinese trademark counsel to get their opinion on how best to proceed against this school.
In regards to your specific questions, there is no connection whatsoever between the Harvard Business School (HBS) and the America Harvord Business Institute. Also, Harvard Business School does have an Asia-Pacific Research Center based in Hong Kong, and a Japan Research Office based in Tokyo. Further information about these and other HBS centers can be found on the Harvard Business School's Web site at www.hbs.edu/global/research_centers.html. However, HBS does not partner with other schools, in the U.S. or abroad, in offering its MBA degree, so there are no affiliations with universities in China on that dimension. That is not to say other collaborative work isn't happening -- for example, HBS has, for the past few years, collaborated with Tsinghua University in offering an executive education program.

In the meantime, you can let your readers know that Harvard Business School is not connected at all with America Harvord Business Institute and that Harvard University is now lookingotnithe matter and will take any and all appropriate action to stop any unauthorized use of the Harvard name in China as well as to stop any confusion being caused by this school. In fact, Harvard University has the "Harvard" name registered in China in Chinese Characters for "educational services" (we also have it registered for "educational services" in the Latin script). If, as you say, besides using "Harvord" they are also using "Harvard" in Chinese characters in their name then this is even further evidence of trademark infringement and the unauthorized use of our name.

9月1日，记者到国家工商总局、北京市工商局查询“美国哈佛商学院中国代表处”登记信息，并没有这个机构存在。
北京中仁律师事务所一位资深律师就此接受本报记者采访时表示，“哈佛”作为世界驰名商标，根据国际公约《商标国际注册马德里协定》在全世界范围内受保护。况且哈佛大学已经注册了“哈佛”的中文名字，如果任何机构用带有“哈佛商学院”字样作为注册商标，工商部门和其他行政部门是不会允许其注册登记。在未经国内相关部门合法登记注册的情况下，如果没有在国内相关部门合法登记而冒用哈佛商学院的中文名字以及使用印章，在刑事上涉嫌私刻公章和诈骗罪，在民商法方面看则涉嫌侵犯了驰名商标权。
据悉，哈佛商学院已经和哈佛在中国负责商标事务的律师联系，考虑如何对“美国哈佛商学院中国代表处”采取行动。
